iTuscan is a travel agency promoting and finalizing rentals of villas, houses and apartments in the name and on behalf of the owners  of the above mentioned.

The booking of an apartment shall be definitely confirmed only upon reception of a security deposit for confirmation. In order to arrange a booking the customer has to expressly accept the following General Conditions of the contract.

The rental prices displayed on the Website iTuscan.com are divided according to the season and are meant per apartment unit per week (unless differently expressed in the description of the apartment) and from Saturday to Saturday. Eventual extra costs (indicated in the description of every apartment) are not included in the rental price and have to be paid on site directly to the owner of the apartment or to a person in charge. The rental prices form an integral part of the present General Conditions;

Bookings have to be made exclusively on the website iTuscan.com and in two ways:
“Immediate Booking”
For all reservations with arrival from Saturday to Saturday and for stays of at least one week
“Booking on Request”
For all reservations with arrival and departure midweek and stays of less than one week but always longer than 3 days (only for low season)

When booking the customer has to pay iTuscan an advanced security deposit of 25% by credit card or bank transfer for confirmation. Upon reception of the deposit a Confirmation of received payment will be sent from iTuscan to the customer. Only when receiving this document shall the customer have guarantee of confirmed booking. The remaining amount shall be paid directly to the owner of the apartment or to iTuscan (depending on the apartment) at least 45 days before arrival. The payment of the remaining amount of the rental price is binding to make sure the apartment will be available. Upon reception of the complete payment iTuscan will send the customer a voucher that shall be shown to the owner of the apartment or to his representatives on the day of arrival. The voucher will be issued on the customer’s name and on the amount of confirmed people indicated when booking. Any change or particular request will have to be authorized by iTuscan.

Arrivals in rented apartments are accepted on Saturday afternoon from 15.00 to 18.00. In specific cases midweek arrivals are allowed but the arrival time will be the same and accepted upon direct agreement with the owner of the apartment. In the event of a delay on the day of arrival, the guest is obliged to inform the owner by 12.00 ‘o clock on the day of arrival. For some of the apartments, if expressed in the description, the guest has to pay a security deposit in cash upon reception of the keys. This deposit will be given back to the guest on departure and upon deduction of the amount of any damage caused to the apartment. The guest is in any case responsible for any damage caused to the apartment  for amounts that exceed the security deposit. The guest has to leave the apartment from 8.00 to 10.00 on Saturday, in order to allow the owner or one of his representatives  to clean the house before new tourists arrive. The owner keeps the right to access the house for necessary maintenance (garden, swimming pool etc).

All apartments are described carefully and in good faith. In the exceptional event of any change made to one of the apartments beyond the knowledge of iTuscan, the latter declines any liability but will try to solve the inconvenience at their best. Possible claims have to be addressed directly to the owner of the apartment or, in his absence, put into writing and sent to iTuscan within 48 hours from the arrival and in any case by 18.00 ‘o clock on Monday after arrival. Any claim not notified in written form to iTuscan as per the above terms will not be taken into consideration. In case of claim, iTuscan reserves the right to check the reasons of a claim on site and during the guest’s stay by means of a person in charge. The customer is obliged to give iTuscan the time necessary to try to solve the inconvenience. In case no written notice is sent to iTuscan as per the terms described above and a guest leaves the apartment in advance, any right for refund of the rental price will be lost and in no case will refund be raised for hotel costs or any other cost paid by the guest. iTuscan does not accept lack of electricity, gas or water as a reason for claim, if this is due to the suppliers of the service.

In the event that an apartment can’t be used due to circumstances of force majeure, iTuscan reserves the right to assign the customer a different apartment with similar or superior features or in extreme cases to cancel the booking and refund the customer of the price paid for the booking, thus excluding the right to put forward any further claim for refund. If a guest accepts the new apartment any right for further compensation or requests of any kind will be excluded.

In the event a guest shall cancel his booking for any reason, he will have a right for reimbursement of the amount paid with deduction of booking charges and penalty charges as follows:
From booking to 45 days before arrival ----> Deposit paid
From 45 to 30 days before arrival         ----> Penalty charge of 30%
From 29 to 15 days before arrival         ----> Penalty charge of 50%
From 14 to 3 days before arrival                       ----> Penalty charge of 80%
From 3 days to the day of arrival          ----> Penalty charge of 90%

The National Fund (governed by law 206/05 art. 100 of the new Consumer Code) was instituted to protect consumers travelling in case of insolvency or bankruptcy of the vendor (tour operator or travel agent) and allows a reimbursement to the consumer for the price paid for the trip (the reimbursement is limited to the part of the trip paid and not yet used). ITuscan operates in accordance with all legal requirements (International Convention on Tour Contracts C.V.V. endorsed by Italian Law no. 1084 of 27.12.77 and C.E.E. Directive 90/314 of 13.06.90) and insures all clients with Assicurazioni Generali Spa follows :- Policy for public liability to all clients of tour programmes or holiday leases in accordance with Art. 13 of The Regional Law of Tuscany no.16/94 and successive changes as approved by the Regional Council of Tuscany. Policy with Assicurazioni Generali Spa, agency of Poggibonsi. This guarantees clients and the buildings they use during the period of their vacation.

By signing a lease for one of the company’s properties the client must fully understand that on entering the property he or she becomes liable for any damage caused by him or her whether civil or criminal. The client by claiming ignorance of these conditions and terms cannot assign either to iTuscan or the property owner any responsibility for his actions. By law iTuscan must ensure that the client signs a booking form carrying these terms and conditions. The person signing the booking form as indicated in the voucher (see 4 above) will be held responsible for the lease. Ituscan properties are not hotels but private homes. Their equipment, furniture and characteristics reflect the owners’ tastes, local traditions and architecture and do not reflect the standard grading used by hotels. Therefore Ituscan will not consider these elements as a cause of complaint.

The original form of these terms and conditions written in Italian shall be considered binding. In the event of any dispute or irreconcilable disagreement regarding these terms and conditions the competent court for settlement of claims shall be Siena.

In order to valid the booking, Ituscan need some personal information on the client. Ituscan is responsible for managing these data as per the D. LGS. 196/2003 (Italian Law) and will save this personal information in an independent database. These data will be used by Ituscan only to valid the booking and to communicate with the client for the present and the future. In any case this personal information will not be forwarded to any other third parties (the only exceptions are in case of contract and Italian law obligation). In any case, Ituscan remind that the client has the right to be informed and to oppose to the use of this personal information as per the art. 7 of the above mentioned D. LGS. 196/2003.
